In compliance with the principles of lawfulness and transparency and in order to provide the information to data subjects established in articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, hereinafter RGPD, we inform you of the characteristics of the processing of personal data carried out under the responsibility of HOTEL LA ISLA Y EL MAR (Explotación Apartamentos Balcón del Mar, SL), with NIF B35477165:

Processing:

  1. (I) Management of the accommodation service.
  2. (II) Signing up guests.
  3. (III) Administrative management.
  4. (IV) Invoicing, accounting and tax management.
  5. (V) Ensuring the privacy rights of data subjects.
  6. (VI) Human Resources Management.
  7. (VIII) Sales management.
  8. (IX) Newsletter subscription.

Purpose:

  1. (I) Providing the requested accommodation service.
  2. (II) Communicating the legally established data to the State Security Forces and Corps.
  3. (III) To carry out the complete administrative management of the same.
  4. (IV) Preparation of invoices to customers, preparation of official accounting and calculations, presentation and settlement of taxes, preparation of commercial documents, such as balance sheets and reports.
  5. (V) Dealing with requests for the exercise of rights related to personal data, as well as security breaches that may affect the rights and freedoms of the interested parties.
  6. (VI) Personnel selection, training, and the necessary steps for the employment relationship.
  7. (VII) Control of the facilities through a video surveillance system.
  8. (VIII) To send you commercial communications, if you authorise us to do so.
  9. (IX) Sending of electronic newsletter with news and promotions.

Legal basis:

  1. (I) and (III) Application of contractual and pre-contractual measures.
  2. (II) L.O. 4/2015, of 30 March, on Citizen Security and Order INT/1922/2003, of 4 July.
  3. (IV) Law 58/2003, of 17 December, on General Taxation.
  4. (V) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data.
  5. (VI) Execution of a contract or pre-contract.
  6. (VII) Public interest.
  7. (VIII) and (IX) Consent of the data subject.

Storage period:

  1. (I) For the duration of the provision of the service and the period necessary to address responsibilities derived from it.
  2. (II) Three years for the purposes of communication to the State Security Forces and Corps.
  3. (III) and (IV) Six years for commercial purposes, and the period necessary to deal with responsibilities derived from the settlement of taxes.
  4. (V) The period necessary for the fulfilment of said purpose, as well as for the duration of the responsibilities that may arise therefrom.
  5. (VI) Duration of the employment contract and the period necessary to deal with responsibilities derived from the employment benefit.
  6. (VII) No more than one month.
  7. (VIII) and (IX) As long as the data subject does not unsubscribe from any communication received, and for the period of time necessary to comply with the responsibilities that may arise from all the above processing operations

Recipients:

  1. (II) State Security Forces and Corps.
  2. (V) Spanish Data Protection Agency.

Exercise of rights:

You may exercise your right of access, rectification, deletion, limitation and opposition to processing, under the terms and conditions established in the regulations on personal data protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, by sending a request by email to: dpd@martinezhermanos.com, indicating in any case the Reference: “Data Protection” together with some document proving your identity, and clearly indicating the right you wish to exercise. Finally, you may file a complaint with the Spanish Data Protection Agency, especially when you have not been satisfied with the exercise of your rights.
